Germany Considers Strict Rules for Proposed Fuel Price Cap by 2027
The German Federal Ministry for Economic Affairs has outlined preliminary plans to introduce a temporary fuel price cap for gasoline and diesel by January 1, 2027.
The German Federal Ministry for Economic Affairs, led by Minister Katherina Reiche, has released an initial draft bill titled the Fuel Maximum Price Act, outlining strict criteria for a planned state-imposed fuel price cap. Set to take effect no later than January 1, 2027, the measure aims to protect drivers from crisis-induced price spikes, such as those triggered by the ongoing conflict involving Iran. The current fuel discount is scheduled to expire at the end of December.
Under the newly proposed guidelines currently circulating within early government coordination, the state-enforced maximum price would only apply under specific objective conditions designed to mirror regulations found in countries like Luxembourg and Belgium. According to the draft, a government-mandated price ceiling would trigger only if domestic fuel prices increase over three consecutive weeks at a rate significantly exceeding the European Union average, specifically by at least five percentage points higher week-over-week compared to other EU member states.
Furthermore, the legislation proposes strict time limitations, dictating that any maximum price regulation can remain in effect for a maximum of three months at a time. The ministry also emphasized that the measure is intended solely as an emergency instrument rather than a permanent market fixture. To address varying regional conditions, the draft allows individual federal states to determine differing maximum prices for specific counties, districts, or postal code areas to account for local transportation costs and competitive environments.
A central concern driving the ministry's cautious approach is the preservation of domestic supply security and the protection of the domestic refining industry. Reiche has repeatedly warned that setting price caps too low could render fuel imports and domestic refining unprofitable, potentially resulting in supply shortages. Consequently, the application of the price ceiling can be entirely suspended if energy supply security is threatened.
The initial legislative proposal has elicited mixed reactions from political parties and advocacy groups. Armand Zorn, a parliamentary group vice leader for the Social Democratic Party, indicated that his party would measure the final bill against its ability to effectively limit the profit margins of the mineral oil industry and provide tangible relief for consumers. Conversely, critics such as Greenpeace transport expert Marissa Reiserer argued that the stringent criteria render the cap a paper tiger, warning that there are hardly any scenarios where the threshold would actually be met.
Opposition figures have also voiced skepticism, with Left Party lawmaker Janine Wissler accusing Reiche of attempting to sabotage the coalition's agreement, while Green Party energy politician Michael Kellner suggested an excess profits tax would be a more suitable policy instrument. As the draft moves through internal government coordination, motorists continue to face standard market fluctuations and regional pricing discrepancies at the pump ahead of the potential 2027 implementation.
