Judge Denies Restraining Order Against Halle Berry in Custody Case
A Los Angeles judge dismissed a domestic violence restraining order request filed by Olivier Martinez against his ex-wife, Halle Berry.
A Los Angeles judge has rejected a domestic violence restraining order request filed by actor Olivier Martinez against his ex-wife, Halle Berry, following a lengthy custody dispute regarding their 13-year-old son, Maceo. Superior Court Judge Shelley Kaufman dissolved the temporary restrictions previously placed on the Oscar-winning actress after a nine-day court process that involved confidential testimony from family members and professionals.
The legal battle escalated after Martinez accused Berry of physically abusing their son during an alleged incident on September 26. In early October, Martinez sought sole physical and legal custody of Maceo, leading the court to issue a temporary protection order on October 1 and restrict Berry's visitation schedule to specific weekend and weekday hours.
Berry firmly denied the accusations throughout the proceedings. In a declaration, she stated, "I have never physically, emotionally, or otherwise abused Maceo. I am a victim of domestic violence, and I help victims of domestic violence. I am not a perpetrator of violence. I would never hurt our child." Her attorney, Marina Beck, expressed satisfaction with the court's decision, telling the press that the team was pleased the temporary restraining order was revoked and emphasizing that Berry remains committed to prioritizing her family's well-being.
Despite the dismissal of the restraining order, the legal conflict between the former spouses is ongoing. According to reports, a modified visitation arrangement has been temporarily extended until the parties return to court in November, with Martinez currently holding primary physical custody. Meanwhile, Berry maintains joint legal custody and retains the deciding vote in the event of disagreements between the parents.
During the closed-door court hearings, several individuals provided testimony, including the former couple's son Maceo, who reportedly spoke before the judge for nearly four hours. Additional testimony was provided by a school official, a therapist, Berry's older daughter Nahla Aubry, and Berry's fiancé, Van Hunt. In prior court filings, Nahla expressed shock over the abuse allegations, stating she had never witnessed her mother act aggressively toward her younger brother.
The ongoing disputes also involved reciprocal accusations. Berry's legal team contended that Martinez had repeatedly violated court orders and interfered with necessary therapeutic and educational interventions for their son. Berry had previously sought sole legal custody while proposing to maintain a weekly alternating living arrangement for the teenager.
Halle Berry and Olivier Martinez were married in July 2013 and separated two years later. Although they were declared legally single in December 2016, their divorce was formally finalized in August 2023. The former couple is scheduled to return to court in November as discussions regarding the long-term custody arrangement continue.
